Class Action Terms
Last updated October 16, 2025. These terms contain an agreement to arbitrate and a class action waiver. They affect your rights. Please read them carefully.
1. Agreement to Arbitrate & Class Action Waiver
By creating an account, accessing, or using Gimme, you and Von Ventures, LLC agree that any dispute, claim, or controversy between you and Von Ventures, LLC arising out of or relating to Gimme, these terms, or our relationship (collectively, “Disputes”) will be resolved by binding individual arbitration and not in court. You and Von Ventures, LLC also agree to waive any right to participate in a class, consolidated, or representative action or proceeding.

2. Disputes Covered
“Disputes” is defined broadly and includes claims based on contract, statute, regulation, ordinance, tort (including negligence), fraud, misrepresentation, or any other legal or equitable theory, regardless of when the claim arose and whether it arose before or after you agreed to these terms.
3. Informal Resolution First
Before either party may commence arbitration, the party seeking arbitration must send the other a written Notice of Dispute describing the nature and basis of the claim and the requested relief. A Notice to Von Ventures, LLC must be emailed to team@gimmemymoney.app and mailed to 8301 State Line Rd Ste 220 Kansas City, MO 64114. The parties will attempt to resolve the Dispute informally for 60 days from receipt of the notice.
4. Individual Arbitration
- Administrator & Rules. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by this section.
- Arbitrator. A single, neutral arbitrator will decide all issues, including the scope and enforceability of this arbitration agreement.
- Location & Hearing. You may choose phone, video, written submissions, or in-person in the county where you live.
- Relief Available. The arbitrator may award individual relief available in court, including injunctive relief, to the extent necessary to remedy your claim.
5. Fees & Costs
Von Ventures, LLC will pay all AAA filing, administration, and arbitrator fees for any arbitration it initiates. For arbitrations you initiate, you will pay the consumer filing fee, and Von Ventures, LLC will pay the remaining AAA fees. Each party bears its own attorneys’ fees and costs unless the arbitrator awards otherwise under applicable law.
6. Exceptions
- Small Claims. Either party may bring an individual claim in small claims court.
- Injunctive Relief. Either party may seek temporary injunctive relief in court to preserve the status quo pending arbitration.
7. Right to Opt Out
You may opt out of arbitration and the class action waiver by sending a written opt-out notice to team@gimmemymoney.app within 30 days after you first accept these terms.
8. No Class or Representative Actions
Disputes must be brought solely in your or Von Ventures, LLC’s individual capacity. The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.
9. Severability & Survival
If the class action waiver is found unenforceable as to a particular claim, that claim proceeds in court and the remainder proceeds in arbitration. This section survives termination of your account or use of Gimme.
10. Changes to These Terms
Von Ventures, LLC may modify these Class Action Terms as permitted by law. Material changes will be noticed; changes won’t apply to Disputes for which a Notice of Dispute has already been provided.
11. Starting Arbitration
To begin arbitration, send the Notice of Dispute and file a Demand for Arbitration with AAA. See adr.org.
